The North West Provincial Legislature’s Portfolio Committee on Public Works and Roads, Community Safety and Transport Management led by Hon Mmoloki Cwaile held a joint meeting with the North West Legislature’s Portfolio Committee on Premier and Finance led by Hon Aron Motswana to discuss the status and future of the North West Transport Investment (NTI).
The MEC for the Department of Community Safety and Transport Management, MEC Sello Lehari including senior officials of the department as well as officials from the Office of the Premier and Provincial Treasury formed part of the meeting. The Business Rescue Practitioner (BRP), Mr Thomas Samson failed to attend the meeting.
The committee was amongst others concerned that the BRP is still operating at NTI, despite their support towards the Department of Community Safety and Transport Management’s decision to terminate and not extend the contract of the Business Rescue Practitioner (BRP) with immediate effect to safeguard monies of government.
The department’s failed attempt to remove Mr Samson for amongst others failing to submit Business Rescue plan as per terms of reference and extended his contract while not having adhered to terms of reference for his appointment left the committee to suggest foul play.
The committee noted with concern the continuous disrespect shown by the BRP and his refusal to communicate with the department on operational work of NTI.
The BRP has amongst others failed to follow supply chain management and PFMA even after being advised by Provincial Treasury. He allegedly transferred R2m into his account and continues to use funds allocated for NTI to fight his legal battles. The Workers were only paid 40% of their salary wages for the month of February and March whilst creditors are owed close to R1.2 billion in debt. The workers have not been paid for recent past months.
The committee have opened a criminal case against the department to address the irregular appointment of the BRP and alleged financial misconduct. #Story to follow
